1) Orders

An order becomes binding upon receipt on our server together with payment.

Order acceptance implies that the customer is clearly identified by carefully completing the online order form with valid and accurate information, including name, postal address, email address and telephone number.

The seller reserves the right to refuse or cancel any order for legitimate reasons, including inaccurate information, payment incident, suspected fraud or exceptional product unavailability.

Stock availability is indicated on the website for each item, size and colour. In the event of unexpected unavailability after the order has been placed, the customer will be informed by email and may either accept a longer delivery time or cancel all or part of the order.

2) Products

The products offered for sale are those displayed on the website on the day of consultation, subject to stock availability.

The essential characteristics of the products are shown on the product pages, including product name, colour, size, composition and, where applicable, care instructions.

Photographs and visuals are presented with the greatest possible care. However, slight differences may exist depending on screen settings. The care advice shown on product pages is for guidance only; only the care label attached to the item is authoritative.

3) Prices

Prices are indicated in euros, all taxes included regarding the country delivered.

The customer is informed of the total price payable when placing the order and undertakes to pay the full amount, including any delivery costs, in advance at the time the order is confirmed.

Delivery charges are calculated according to the destination country and the shipping method selected at checkout.

The seller reserves the right to modify prices at any time, it being understood that the price charged is the one applicable at the time of the order.

4) Loyalty Program and Referral

The loyalty program operates on a points basis: 1 euro spent on the website, excluding refunded amounts, gives entitlement to 1 point.

From 400 accumulated points, valid for 360 days and usable 5 days after the order, a discount may be offered, excluding sale items.

The referral program grants 50 points to the referrer and 20 points to the referred customer upon the referred customer’s first order, excluding refunded amounts.

The seller reserves the right to modify, suspend or cancel the loyalty and referral programs at any time.

5) Payment

Payment is made online at the end of the ordering process by bank card through a secure SSL-compliant system.

Validation of the payment and transmission of the bank card details constitute proof of the order and final confirmation of the purchase, subject to acceptance by the relevant banking institutions.

If payment is refused or a banking incident occurs, the order cannot be processed.

6) Delivery

Orders are dispatched as quickly as possible, subject to stock availability, within an indicative period of 72 hours for orders placed before 1 p.m., or 96 hours for orders placed during weekends or public holidays.

The customer is informed by email when the order is dispatched and receives a tracking number to follow the parcel, in particular via Colissimo when this carrier is used.

Products are sold only to the countries listed in the delivery section of the website at the time of the order.

Delivery times are provided for information purposes only. In case of unexpected stock shortage, the customer will be informed by email and may accept a longer delay or cancel the relevant order.

The customer must check the apparent condition of the parcel and the products upon delivery and report any anomaly or reservation to the carrier and customer service as soon as possible.

The customer must provide a full and accurate delivery address. In the event of an incorrect or incomplete address, or if the parcel is not collected within the carrier’s time limits, re-shipping costs may be charged to the customer.

For returns sent from outside the European Union, the customer must state “return of goods” on the customs document. Any return generating customs duties or VAT upon receipt may be refused.

Customs duties, import taxes and local charges
For deliveries outside the European Union, customs duties, import VAT, local taxes and any customs clearance fees that may be charged by the destination country remain solely the responsibility of the customer. These charges are determined by the authorities of the destination country and are outside the seller’s control. The customer is solely responsible for obtaining information from local authorities regarding any applicable import duties and taxes before placing an order. Refusal to pay such charges by the customer shall not give rise to reimbursement of shipping costs or any customs-related fees incurred.

7) Right of Withdrawal, Returns and Exchanges

In accordance with French consumer law, the consumer customer has a period of 14 calendar days from the day following receipt of the order to exercise the right of withdrawal, without having to give any reason.

To exercise this right, the customer must notify the seller before the expiry of the withdrawal period, in particular by email at [email protected].

After such notification, the customer has 14 days to return the relevant item(s).

Return shipping costs remain the responsibility of the customer.

Returned products must be unworn, unwashed, unstained, undamaged, returned with their labels where present, and properly packed, preferably in their original packaging where possible.

The customer may be held liable for any depreciation resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the goods.

Refunds will be made within a maximum of 14 days from the date on which the seller is informed of the customer’s decision to withdraw. The seller may defer reimbursement until the goods have been received back or until the customer has supplied proof of dispatch, whichever comes first.

Refunds are made using the same method of payment used for the order, unless the customer expressly agrees otherwise.

Any request for an exchange may be sent to [email protected]. An exchange may be accepted subject to availability and provided that the products are returned in a condition allowing immediate resale.

8) Legal Warranties

The consumer customer benefits from the legal warranty of conformity provided by French law and from the warranty against hidden defects under the French Civil Code.

Under the legal warranty of conformity, the customer has two years from delivery of the goods to act. The seller is required to deliver goods that conform to the contract and is liable for defects existing at the time of delivery.

Under the warranty against hidden defects, the customer may act within two years from discovery of the hidden defect.

For any request relating to a legal warranty, the customer may contact [email protected].

Unless expressly stated otherwise, no commercial warranty is granted in addition to the legal warranties.

9) Customer Service

For any question, complaint, request relating to an order, return, exchange or warranty, the customer may contact customer service by email at [email protected].

The cost of distance communication does not exceed the normal non-premium rate.

10) Data Protection

The information provided by the customer is necessary for the processing and delivery of the order and for customer service management.

In accordance with applicable data protection regulations, the customer has rights of access, rectification, erasure and objection regarding personal data. For more information, the customer is invited to consult the website’s privacy policy.

11) Liability

The seller shall not be held liable for any non-performance or improper performance of the contract attributable either to the customer, to an unforeseeable and unavoidable act of a third party, or to a case of force majeure.

In the event of a delivery dispute, a reshipment or refund may be considered after verification with the carrier and depending on the circumstances of the case.

12) Consumer Mediation and Disputes

In the event of a dispute, the customer is invited to contact customer service first in order to seek an amicable solution.

In accordance with Article L.612-1 of the French Consumer Code, after a prior written complaint has remained unsuccessful, the customer may refer the matter free of charge to the consumer mediator used by the seller:

CM2C
14 rue Saint-Jean
75017 Paris
France

These Terms and Conditions are governed by French law. If an amicable solution cannot be reached, the consumer may bring the matter before the competent courts under ordinary French law.

13) Miscellaneous

No deposit or financial guarantee is required from the customer.

No minimum contractual commitment period is imposed on the customer.

No specific code of conduct applies.
